📋 SigmoAI Affiliate Program Agreement

1. Enrollment in the Program

To enroll, you must sign in using your Google Account. We reserve the right to approve or reject any application at our sole discretion.

2. Commission Structure

You will earn 20% recurring commission on each active paid subscription you refer.

• Commission is paid weekly for up to 52 weeks (12 months) per subscriber.
• A user must sign up using your unique affiliate link for the referral to qualify.
• If a subscriber cancels and returns within 90 days, commissions resume where they left off.
• If a subscriber cancels for more than 90 days, commission eligibility resets to zero.

No commission is paid for:

• Canceled subscriptions (commissions stop immediately)
• Refunded payments
• Fraudulent signups
• Self-referrals

3. Payout Requirements

• Minimum payout amount: $20 USD
• Payouts are made via: PayPal, Wise, or any method listed in your dashboard
• You must submit the correct tax form before we release payouts:
  • W-9 (U.S. affiliates)
  • W-8BEN (International affiliates)

4. FTC Disclosure Requirements

Affiliates must clearly disclose the affiliate relationship in all promotions.

Examples of acceptable disclosure:

• "I may earn a commission if you subscribe using my link."
• "This post contains an affiliate link. I get a small commission at no extra cost to you."

Disclosures must be:

• ✅ Clear
• ✅ Easy to read
• ✅ Not hidden
• ✅ Placed close to the affiliate link or promotion

5. Prohibited Marketing Activities

To protect users and stay compliant, Affiliates MUST NOT:

5.1 No false or misleading claims

You may not:

• ❌ Claim guaranteed profits
• ❌ Claim specific income results
• ❌ Claim SigmoAI provides financial advice
• ❌ Exaggerate performance or accuracy
• ❌ Promise "risk-free trades"

5.2 No spam

You may not:

• ❌ Send unsolicited mass emails
• ❌ Post affiliate links in spammy comments
• ❌ Use bots, fake accounts, or automated spam tools

5.3 No impersonation

You may not impersonate SigmoAI, our founders, or our support team.

5.4 No unethical behavior

You may not promote SigmoAI using:

• ❌ Hate speech
• ❌ Illegal content
• ❌ Adult content
• ❌ Scams
• ❌ Malware

We reserve the right to determine violations.

6. Acceptable Promotional Activities

Affiliates may legitimately promote SigmoAI via:

• ✅ TikTok, Instagram, Facebook, Twitter/X
• ✅ YouTube content
• ✅ Blogs and websites
• ✅ Email newsletters (opt-in only)
• ✅ WhatsApp or Telegram groups (no spam)
• ✅ Paid ads (approval required)

7. Taxes and Legal Compliance

• You are responsible for your own taxes.
• We will issue a 1099-NEC for U.S. affiliates who earn $600+ in a calendar year.

8. Termination

We may terminate or suspend your account if:

• You violate any part of this Agreement
• You misuse your affiliate link
• You engage in fraudulent activity
• You promote SigmoAI using prohibited claims

Affiliate may terminate participation at any time by stopping promotion.

9. Limitation of Liability

SigmoAI is not responsible for:

• Lost profits
• Network failures
• Tracking issues caused by third-party browsers
• Suspension of payment methods
• User cancellations

Our total liability will not exceed the commissions paid to you in the past 12 months.

10. Independent Contractor Status

Affiliates are not employees of SigmoAI. You are an independent contractor and responsible for your own compliance.

11. Modifications to the Program

We may update commission structure, rules, or payout methods at any time. You will be notified of material changes.

Continued participation = acceptance of changes.

12. Governing Law

This Agreement is governed by the laws of the United States and the State of Texas.
